Los Archives in Digital Government Legislation
Abstract
The text analyzes the regulation of the Digital Government Law and highlights the work that the Archivo General de la Nación assumes in terms of the regulations regarding the care of digital archival documents, in accordance with its competence stipulated by law. In this regard, it refers to Chapter IV of the regulation —on digital archiving—, where the normative work of the AGN is apparently focused, but specifies that beyond this chapter, the entire legal provision in question has an impact on digital archives. This is because the administrative procedures, for the purposes of the law and its regulations, are carried out through archival documents that will be managed on media other than paper —digital—, through the implementation of document management systems at the national level, and it is up to the AGN to assume their technical-archival treatment. Finally, the article briefly discusses the data that both the law and its regulations contemplate, bearing in mind that the requirements in the value and quality of these correspond to the value and quality of digital records as one of the main sources for their management, use and availability.
